Judicial accountability vs independence

• Judicial independence define the absence of judiciary dependence on other organs of State i.e. Executive and
Legislature, along with the power of the judiciary to administer justice impartially and honestly.
(a) Provisions highlighting judicial independence include security of tenure, no discussion on the conduct of judges in parliament, prohibition on practice after retirement.
• Both the terms are interrelated in the sense that excessive independence can decrease accountability and vice versa. So, it is necessary to maintain a balance between both.
(a) This balance is achieved by making the judiciary accountable for its actions through the removal of judges by parliament, provisions for appeals , revision, and review of the orders of courts, ethical code of conduct for judges, etc.
